Houston Woman Charged With Injury to Child In Death of Child

A Houston woman has been charged with the First Degree Felony of Injury to a Child accused of causing serious bodily injury to her child which resulted in death, according to this story.

The child, a 19 month old baby girl, passed away after being taken off of life support on June 20th. When brought to the hospital, the child was diagnosed with multiple skull fractures and brain hemorrhaging and swelling.

The woman claimed that she may have  blacked out and unintentionally injured her daughter. A physician and child abuse expert stated that the severity and pattern of the infant’s injuries which included skull fractures and intracranial hemorrhages were consistent with multiple enormous impacts to the back of the head.

The charge of Injury to a Child that results in serious bodily injury is a First Degree Felony which carries a possible punishment of not more than 99 years or life and not less than 5 years in prison.

It is not clear whether the Harris County District Attorney’s Office will upgrade the charge. If the State believes they can meet the elements of Capital Murder (in this case the murder of a person under 6 years old) they could possible upgrade the charge.

A Seabrook couple have been charged with Injury to a Child according to this story. The couple is accused of beating their 11-year-old son with a leather belt and applying vinegar, salt and alcohol to his wounds. Injury to a Child is a felony and can be charged from a State Jail Felony to a 1st Degree Felony depending on the injury and the intent of the accused.

In this case the couple are accused of intentionally causing serious bodily injury which is a 1st Degree Felony. The story states that in addition to the injuries from the beatings, chemicals such as alcohol, salt or vinegar were applied to the injuries almost on a daily basis, and this caused the victim to suffer great pain and disfigurement including severe burn injuries.

Houston Man Charged With Injury To A Child After Giving Daughter A Gun

A Houston man allegedly beat his daughter  and gave her a gun and knife and told her to kill herself according to the Houston Chronicle. The girl is 11 years old.

According to the complaint, the girl said Galvan hit her in the stomach, legs and buttocks with a belt. She also said he punched her in her right arm. She told investigators he handed her a black gun, which she thought was loaded, along with a knife that he told her to use if she really wanted to commit suicide.

Criminal Suspect

The man was charged with Endangering a Child and Injury to a Child which are both felony offenses.

The case has garnered a lot of attention in the local media due to the alleged cruelty by the father of giving his daughter deadly weapons to kill herself. However, the charges are far from the most serious of felony offenses.

Endanger a Child is  State Jail Felony and carries a punishment range of 180 days to 2 years in the State Jail. Injury to a Child is an offense that can be charged under different felony levels depending on the injury to the victim and the intent of the defendant.

In the present case the state has charged the man with a Third Degree Felony of Injury to a Child which would require the state to prove the man intentionally and knowingly caused bodily injury. A Third Degree Felony carries a range of punishment of 2-10 years in the Texas Department of Corrections.

Mother Charged With Injury To Child In Death of Daughter

According to the Houston Chronicle a 19 year old woman, Emma Cardona, was charged with Injury to a Child in the death of her 2 year old daughter.  The toddler suffered a large brain hemorrhage and bruises all over her body, including a large contusion on her forehead, according to a criminal complaint filed in Harris County District Court on Friday.

The child’s cause of death was blunt force head trauma, records show.

Injury to a Child is a Felony Offense. The charge can be one of four different levels of felony offense, from State Jail Felony to a First Degree Felony depending on the intent of the defendant and the injury sustained by the victim.
